<p>A back disability can leave a person realizing how much they use their back on the job. As a back disability attorney I have seen the Dr. tell the client that they need back surgery, and may not be able to return to their job. Unfortunately after the first back surgery many of my clients discover that they can no longer work at all, as a back disability attorney I have seen this so many times. Just having mobility can be an issue for many back injury clients who have surgery, many clients have to use assistants in walking, or have to take pain medication.  </p>
<p>The damage  and surgery to the spine and back can range from ruptured discs; scoliosis; harrington rod implant; stimulator implant; spinal fusion,  and many other types of surgery and damages to the spine and back. A back surgery is a very serious situation, and letting social security disability know about it is very important.   In my experiences as a back disability attorney I understand that even after surgery many people cant go back to work.</p>

<p>The most common effects from back surgery tends to be the inability to tolerate bending over; tolerate standing for periods of time; sitting down for long periods of time; missing work often;  and constant pain. While many claimants tend to feel better after their surgery, they can never return to their career, and often find it impossible to return to work, due to their physical limitations associated with their back.</p>
<p>Most back surgeries have to be done as a result of  accidents, disease, and or a combination of the two. Knee problems can effect anyone, at anytime. Once the knee has to be replacement, it is generally a life long process that you must deal with, and be able to maintain a job, sometimes maintaining the job becomes impossible due to your limitations, and or the pain associated with knee replacement.    </p>
<p>The requirements to meet this listing are things such as reconstructive surgery on  a major weight bearing  joint, this includes the knee, the listing also requires that you do not have the ability to ambulate effectively, either after the surgery or since you are not a candidate for surgery, you cannot ambulate effectively in your condition. The pain associated with knee problems is tremendous, due to the fact that it is always under pressure from the weight of your body. </p>
<p>In many cases of knee replacement, the pain is constant and the medications used to alleviate the pain are so strong that the claimant cannot perform past work, and or any sedentary work that might be available. Even in sedentary work an individual might be required to use pedals or foot controls, and many knee replacement claimants cannot tolerate the pain from these requirements.</p>

Some people are under the impression that one need only apply, and that will result in receiving benefits, most of the time that is simply not true. The truth is more than not, you will saying they denied my disability, I cant believe it. We see this everyday at our office, please give us a call, after you have said to yourself they denied my disability, make us your next move.  </p>
<p>Today Social Security has developed many ways to apply for disability, you can use the internet, the phone or mail. I encourage clients who come to see me before they apply, to use the internet. If you use the internet you will not have to wait on a phone, and you can apply seven days a week, and at anytime of the day. However, as stated above, you will probably receive the standard denial letter after your application for disability benefits has been fully completed.</p>
<p>Once you are denied disability, the clock is ticking, you are under a  deadline to get your information returned to  Social Security Disability or you risk your case being denied based on a failure to meet the deadlines, this step of the appeal process is known as reconsideration. If you fail to make their deadlines, usually you must refile all over again from the beginning with Social Security.</p>
<p>Once your first appeal is in,  usually you will be denied for a second time, once you are denied the second time you must again meet deadlines or your disability claim will be denied, and you will have to start all over from the beginning. This next step in your appeal process is called asking for an ALJ hearing. There are many forms and documents that must be filled out and returned to Social Security, it may seem like many of the documents have already been filled out when you applied, but you must fill them out again if you wish to properly proceed with your appeal and be heard by the ALJ.  </p>
<p>If there is situation where you have missed your disability deadline by a short time, I have been successful in re-opening cases for clients, and thus they do not have to start all over.  Social Security Disability is very particular about making deadlines in regards to your disability claim.   </p>
<p>After filing for your ALJ hearing at Social Security they will inform you of the new dates, the required paperwork, when your hearing will be, who your vocational expert will be, and when you must provide Social Security Disability with all your updated medical records, without your updated records it may be impossible to prove your claim. I always like to include when possible, a medical source statement filled out by a medical doctor.</p>
<p>Social Security Disability is a daunting task, the above explanation of the claims process is only a glimpse of the work that goes into a client&#8217;s case. 			<content:encoded><![CDATA[<p>There is a listing under the rules of Social Security Disability entitled Disorders of the Spine. In terms that we all use more frequently this would be a back injury, and or back problems, things like back surgery, having screws, pins, plates or cages attached to the spine would fall under this category. It includes problems with the back that have arisen over your life time like herniated disc, arthritis, fractures, nerve root problems and spinal stenosis. Social Security Disability combines these problems, (whichever one you may fall under) and under the listing requires one of the additional following things:</p>
<p>A. Evidence of nerve root compression characterized by neuro-anatomic distribution of pain, limitation of motion of the spine, motor loss (atrophy with associated muscle weakness or muscle weakness) accompanied by sensory or reflex loss and if there is involvement of the lower back, positive straight leg raising test OR</p>
<p>B. Spinal arachnoiditis confirmed by an operative note or pathology report of tissue biopsy or by appropriate medically acceptable imaging, manifested by sever burning or painful dysesthesia, resulting in the need for changes in position or posture more than once every 2 hours OR</p>
<p>C. Lumbar spinal stenosis resulting in pseudoclaudication established by findings on appropriate medically acceptable imaging manifested by chronic nonradicular pain and weakness, and resulting in inability to ambulate effectively.</p>

<p>Many claimants who suffer from Cervical Spine Disorders also suffer from severe pain, this severe pain may result in even sedentary work being impossible to do on a regular basis. 			<content:encoded><![CDATA[<p>Unfortunately I come across cases that sometimes are the result of a hip replacement surgery that has not turned out very well for a host of reasons, I am often asked by clients that phone me, &#8221;is there a disability listing for a bad hip replacement&#8221;? The answer is yes there is, it is a listing called, Reconstructive surgery or surgical arthrodesis of a major weight bearing joint, in terms we all understand a little better, this listing is referring to things such as hip replacement surgery.</p>
<p>One of the key factors to be noted for disability listed under Social Security for hip surgery is the actual notes, medical records are kept very well on hip replacements, even down to the serial number of the hip replacement that was used in your procedure. As noted above, there are a host of reasons that things are not the same with a replaced hip, there are so many, and many reasons unique to each person.</p>
<p>In regards to what is required under the listing, the other key factor is, are you expected to be ambulatory, ie moving about, within the 12 months after surgery? I have found that most hip replacement individuals are not very ambulatory within 12 months, and it seems that the older the claimant, the less likely they will be up and about in 12 months.</p>
<p>Many claimants have commented to me that even when sitting for a period of time it becomes painful, this is important in Social Security Disability claims, because it could possibly eliminate you from being able to do even sedentary work like taking up tickets at a theatre or toll booth. When a hip replacement fails it can be a life changing event for you and your family.</p>

Social Security Disability requires the following, for you to be declared disabled under the listing of a stroke:</p>

<li>Sensory or moro aphasia resulting in ineffective speech or communication; or</li>
<li>Significant and persistent disorganization of motor function in two extremities, resulting in sustained disturbance of gross and dexterous movements, or gait and station.</li>
</ol>
<p>A stroke may inflict many other types damages to the body including, vision, hearing, and understanding. Social Security will take these other type damages into account when determining your disability claim.</p>
<p>It is important in a disability claim where a stroke is the reason for the disability, to explain to the judge not only the outward signs of a stroke, but the issues regarding ones ability to think and reason, sometimes these things are not as apparant, and it is often helpful to explain them at your hearing.</p>
