  • Social Security DisabilityWhat is Social Security Disability? It is an insurance program under Social Security that you pay into when you work, and if you become disabled you then apply for Disability Insurance Benefits through Social Security. You will often hear people say DIB for short when discussing Social Security Disability, they are describing a type of disability benefits under Social Security, there is another type referred to as SSI, this is mainly for people who have not worked enough in their life time to qualify for DIB. What is DIB? Disability Insurance Benefits are for those that qualify after working during their life time, the government keeps up with how long you have worked and the amount of money you have made during your lifetime. To qualify for DIB you must have been gainfully employed for 5 out of the last 10 years before your disability began and have had a threshold earning. Ok , if you meet the financial requirements of DIB, what next? The next step in Social Security Disability is your medical condition. You will have to meet either a listing that is kept by the Social Security Department and medical records to document the medical condition, or meet a place on the grid system developed…
  • Disability QuestionsSocialSecurityDenied.com your disability attorney I have now been taking Social Security Disability claims in Tennessee for close to a decade, I find that many people have some basic questions, such as: How do I get an attorney,  I have no money?Attorneys’ are permitted to take your claim on a contingency fee, meaning if an attorney is not successful in getting your back pay from Social Security, you do not owe a fee. Who is eligible? Most people who have worked the 5 years before they became disabled will qualify for Disability Insurance, there is another program called SSI for people who have not worked enough to qualify for Social Security Disability Insurance. What age do you have to be? It depends on some factors as to your age, a parent may apply for a child, either an adult child or a minor child. The age limit depends on date of birth. How do they determine my disability? Many factors are used by Social Security, some but not all are;  a grid system, a listing of disabilities, your testimony, work history, and medical  records. How do I get started? You will need to apply via the phone or internet to the Social Security Administration. Is…

  • Social Security Disability AppealAfter you have been denied Social Security Disability the initial time and upon denial of your reconsideration, the next process under Social Security Disability will be a hearing in front of a Federal Social Security Disability Judge. It is at this point that I use my trial experience to represent you at your hearing. There are certain things at a hearing in front of a Judge that are very important. I always review proper courtroom procedure with my clients. The hearing takes place either at a hearing office location, or at another designated place. The persons present will be you, the hearing Judge, your attorney, and a vocational expert. Different Judges have  different formats they use in a hearing, some Judges ask you all the questions, and some Judges ask the attorney to ask the questions. The vocational expert will inform the Judge from your testimony and documents submitted, (what type of work you did in the past, and what if any work you can perform now), along with any new evidence that becomes available at the hearing, as to your ability to work. In most cases a decision on your Social Security Disability claim is not made that day by…
  • Hire Disability AttorneyHow do I get attorney for my disability claim, I don’t have any money? Under Social Security Disability Law an attorney is permitted to take on cases for a contingency fee, meaning if you do not receive an award of back pay for your disability claim, you do not owe any money to the attorney. How much is the contingency fee? Under the Social Security Act, the fee cannot be in excess of $6,000.00 dollars. It is calculated by taking 25% of the back pay that you are awarded up to the maximum of $6,000.00. This would mean if you were awarded back pay of $10,000.00 dollars your attorney fee would only be $2,500.00 dollars, so it really depends on your back pay, and the fee can never exceed $6,000.00 for the standard hearing representation. Is there a contract to sign? Yes, under the laws of Social Security Disability there is a contract an attorney must show to Social Security, it is this contract that explains the fee agreement, and notes that there is not a fee unless I recover for you, in your claim. Will Social Security know I have an attorney? Yes, as your attorney I send into Social Security, the…

I have represented people throughout the State of Tennessee and the United States, from the small towns to the large cities. I represent people, and I do not represent corporations or the government, nor have I ever worked for the government. As a graduate of Mississippi College, The School of Law in Jackson, Mississippi, I began my practice as a third year law student. Nearly a decade later I have continued to represent people. My focus has always been on representing people, and for nearly a decade now I have represented disability clients.
