I am often asked can you receive disability if you are obese? The answer is yes with a few conditions and legal analysis. Obesity and or being severely over weight is a serious condition, being obese can lead to severe health care issues and problems. As an attorney I have reviewed and studied the requirements that must be met under some new rules issued by Social Security Disability for obesity.

In appears to me in representation of claimants with severe obesity that many times a major weight bearing joint is affected, meaning a knee, leg, hip, ankle, etc. The reason this is so important as a factor lies in the social security ruling 02-01p(5), does your weight bearing joints and or joint have arthritis and does it affect your ability to ambulate and or walk or stand? I have met with and represented many obese individuals who can no longer walk without the assistance of a cane or walker, there ability to ambulate effectively has stopped, and thus they become disabled.

Losing weight is never easy, and most people I represent simply do not have the money to have surgery to help them with weight loss, so generally under the ruling above it is not a reason alone to deny you disability because you cant afford the weight loss surgery. Many of my clients have tried to lose weight and simply can’t do it.

You need only give us a call if you suffer from severe obesity and or being severely over weight, we would be very pleased to help you. At my law office socialsecuritydenied.com you will speak directly to me, and you can be assured that at my office the most important case is your case.

As an appeal disability denial attorney I hear so often from my clients, I can’t believe they denied my disability claim! It is part of my job as an appeal disability denial attorney to explain to clients that this is the norm, and not the exception. Many of my clients think that because they have worked their entire life the social security disability organization will readily approve their claim, this is very far from the truth.

Social security disability has many factors, work in your past is definitely very important when filing, but most important is, can you work at your job, and or work another job? There are so many factors that they look at in processing your claim, we understand that, at my office we strive to make social security disability aware of as many as possible to assist in appealing your claim, after a denial letter has been received by you.

It is not a good idea to keep refiling after you receive your denial letter, social security disability developed the appeals process for a reason, it is best to use it. By simply refiling your can lose value months of back pay, it is always best to file your appeal. The process moves along much better by following the appeals process developed by social security.

Filing the appeal can be time consuming work, there are also deadlines to meet, should you miss one of these deadlines your claim could be tossed out and dismissed for failure to file in a timely manner. Once my office meets with you, we will handle all the deadlines and make sure your appeal reaches the social security office in time to secure your rights.

At my office we can come to you, once you receive your denial letter just give us a call. At my office the most important case is your case, I look forward to speaking with you.

I have been asked on several occasions, Is a broken leg a disability? In short the answer is dependant on each and every case, and how the broken leg and its ultimate health conquenses effect the claimant, and how old the claimant is at the date of filing.

Breaking your leg, known as the femur bone is a very big health issue. Many times the individual is placed on a pressure machine when the femur bone is broken. Even after leaving the hospital and reaching the point where an individual can walk, the lasting effects of a broken leg can be life changing for an individual who is 50 years of age or older. Many individuals experience a permanent limp, and or require permanent assistance with a cane.

Many of my clients use their legs and backs everyday they work, they carry, lift, move and fix objects that can weigh upwards of 100 pounds or more. With a healed broken leg many clients never gain back their full mobility, and can never lift the weight that they once could at their job. Some clients even are required to use a cane for mobility, and thus their former work is no longer available.

Their is help available, and here at my office socialsecuritydenied.com we can provide it to you. We will review your claim, and there is never a charge unless I collect money for you. At my office the most important case is your case.

Although I am a Nashville social security disability attorney my office at socialsecuritydenied.com covers many states, we adhere to a policy of knowing that our disability clients are more than just a number. We understand how important your case is to you.

I personally take each phone call from new clients, you will speak directly to me, and not a receptionist or paralegal, I represent each client in his or her jurisdiction and or state. From the time you phone me at my disability office, it will be me that you are working with, from initial application, appeals through hearings if required.

Throughout my 14 year legal career I have always been an attorney, I have never worked for the government, I have always represented hard working men and women. My father was a truck driver for over 30 years, I know personally the struggles that can occur when a person has to file for disability, my father filed after becoming ill, and I remember how important the disability process was to him. It is for that reason I have always chosen to represent people and not insurance companies or the government.

We also provide a service of coming to you, should you not want to come to Nashville. You will not be meeting a runner and or a clerk, you will be meeting me at your home. I am honored that someone would invite me into their home for a case.

Please give us a call at socialsecuritydenied.com, we practice on a policy that each case is the most important case, I look forward to speaking you about your disability claim.

PAD also known as Peripheral Arterial Disease , is a disease that prevents parts of the body from receiving blood supply, it is a listing under social security disability law. Many of my clients with PAD will only be able to walk a few blocks, and then claudication takes place, claudication is seen when persons with PAD limp after walking a short distance. It is a direct result of the muscle not receiving enough blood.

PAD affects many individuals as they walk, a muscle at rest may not require as much blood flow, therefore when someone is is not using their muscles claudication will not take place, but as soon as the muscle comes into use, ie walking, the pain begins and the limited blood flow prevents that person from walking, standing, and or performing a function necessary for employment. This is a reason many people seek disability after suffering with PAD.

I have discovered that many claimants take the blood thinning drug called Coumadin. Coumadin can work, however even a minor cut on the job could result in serious injury and or death, because the person will bleed far more freely. PAD is a very serious disease, should you need assistance with your social security disability claim, please feel free to phone me, there is no charge for me to review your claim. I look forward to hearing from you.

MS also known by its full name Multiple Sclerosis is a deadly disease. As your MS disability attorney I understand that MS attacks the brain and central nervous system. The progression of the disease can lead to severe problems with normal autonomic functions, such as digestion, heart rate, breathing and salivation. In latter stages of MS it becomes difficult for many of my clients to control their balance and walk. Fatigue will often overcome many of my clients even though they may still have the ability to walk a block or two. Let us be your choice for an MS disability Attorney.

While in recent years some new and promising breakthroughs have taken place in regards to MS, the continued toll on the body that MS takes is over whelming to most individuals. It destroys many claimants ability to do simple task such as walk, take care of themselves, shop for groceries and live independently.

It is hard for many of my clients to accept the results of MS, many clients tell me that their last resort is filing for disability, as they have drained their savings and have no other options. I always tell clients that filing for disability when you have MS is nothing to be bashful about, the cost of today’s medicines and treatment are far more than most people can afford.

I would be pleased to assist you with your claim, you need only phone my office, and if you can’t come to me, I will come to you. When you phone my law office you will speak directly to me, and I will be the one to represent you through your entire claim. I look forward to helping you and being your MS disability attorney.

As a Crohns Disease attorney I represent individuals who suffer from Crohns Disease, this disease can strike at anytime, and the consequences are painful, and I understand that as a Crohns Disease attorney, if Crohns is not treated properly it can lead to death. Crohns disease involves the bowels, symptoms can be bloody stools, fever, liver disfunctions, and intermittent obstruction. Let us be your Crohns Disease Attorney, nationwide.

Crohns disease can most certainly be described as any inflammation of any part of the gastrointestinal tract, but most often Crohn’s disease is the inflammation of the distal ileum or colon. Sometimes complete removal of the colon is required, however this is no guarantee that the pain will stop. Most Crohns disease claimants go through episodes of the disease, the key part of the Social Security listing for it is, how long does the period of recurrence last? How long does persistence last? How long does the intermittent obstruction last?

Although difficult to discuss, the main issues with Crohn’s disease can be the constant diarrhea and weight loss, the diarrhea is so difficult sometimes that it prevents clients from keeping their job. The weight loss can lead to devastating health issues, and without medical treatment, possibly death.

The drugs used to treat Crohn’s disease can have terrible side effects. The drug Prednisone is used in the most severe cases of the disease. It is most important to describe these side effects to Social Security Disability. Hospital stays are generally part of a client’s treatment if they have been prescribed Prednisone, it is a sign of how serious the condition has become for the client.

The importance of all medical records and client’s testimony relating to this disease cannot be understated. The medical records for a Crohns disease claimant reveal the doctors thoughts, treatments, recurrence, and treatment of the disease, the records are also used to show an arthritic condition that occurs with Crohns disease. The testimony although sometimes hard for the client to discuss is essential as well, it is so very important to let Social SecurityDisability know about your conditions including, diarrhea, fevers, arthritis, and pain.

You have just received a letter telling you that Social Security Disability has your file at the regional hearing office and they will be in touch with you about a hearing, does this sound familiar? It does to many, if not all people who apply for Social Security Disability. Most people phone me and ask, What does this letter really mean? I’m I having a hearing in the next weeks, months, etc. The answer is usually no, most of the time it is many months before you will find yourself before a judge who is assigned to hear your disability claim.

The time between receiving the letter and your disability hearing is a great time to gather and or make Social Security Disability aware of your continuing treatment, or for those who cant afford any treatment, it is a time to see some of the Social Security Doctors, or other health care professionals for the evaluation of your disability. This is also a great time for me to review your records, and before your hearing date write a pre-trial brief.

I prepare a brief for your disability hearing to help point the judge to our strongest medical arguments for your disability claim. It is a brief including your medical records, your history of work, education, and procedural things like when you applied and were denied. It allows the judge to get a snap shot of your case before and during your hearing.

I am often asked, Do I have to say anything? Simply the answer is yes, the disability judge will generally ask you questions about your daily activities, your financial history, your work background, and most importantly your health issues. Honesty in this questioning is crucial to your case, it is never acceptable to answer the judge with anything but the truth. Many times my clients are fearful of some of their answers hurting the claim, and most of their worries are unfounded, honesty is always the best policy at your hearing.

How long until I get a ruling from the disability judge, after my hearing? There is no timeline for a decision, but usually I would say 4 to 5 weeks until a decision will be made. They will send a copy to me as your lawyer, and to you.

These are a few of the things that occure at your hearing for Social Security Disability, should you have any questions always feel free to phone the law office at toll free 1-800-271-2633 or local at 615-308-2633.
