Nashville Attorney Explains Disability

What is Social Security Disability? It is an insurance program under Social Security that you pay into when you work, and if you become disabled you then apply for Disability Insurance Benefits through Social Security.

You will often hear people say DIB for short when discussing Social Security Disability, they are describing a type of disability benefits under Social Security, there is another type referred to as SSI, this is mainly for people who have not worked enough in their life time to qualify for DIB.

What is DIB? Disability Insurance Benefits are for those that qualify after working during their life time, the government keeps up with how long you have worked and the amount of money you have made during your lifetime. To qualify for DIB you must have been gainfully employed for 5 out of the last 10 years before your disability began and have had a threshold earning.

Ok , if you meet the financial requirements of DIB, what next? The next step in Social Security Disability is your medical condition. You will have to meet either a listing that is kept by the Social Security Department and medical records to document the medical condition, or meet a place on the grid system developed by Social Security Disability, along with a medical condition that cant be judged just on it’s own. So there are two ways to meet the medical condition for disability under the government’s rules.

Some other things you will want to consider when applying for Social Security Disability:

  1. When did your disability begin, ie what is your onset date? Why does the onset date matter?
  2. Does the government have to start my back pay they owe me, from the  day I claimed my onset?
  3. Will they ask one of my doctors about my condition?
  4. Will they provide doctors for me?
  5. What is SSI, and is that for me?
  6. Does my past work history matter to Social Security Disability?
  7. How do I pay my lawyer, I dont have any money to pay him?
  8. How do I get my medical records?
  9. Does my attorney know the listings and the grid system Social Security Disability uses?
  10. Will my attorney come and see me?
  11. If the VA declared me disabled, can I still get disability from Social Security?
  12. Does my attorney have a nurse or a doctor to consult with about my claim?
  13. Does Workman’s Compensation offset my backpay due from Social Security?
  14. Do my assets that I have affect my disability backpay under DIB or SSI?
  15. What if I am a Federal Civil Service employee, can I qualify for DIB?
  16. Will Mr. McMurtry come to Kentucky and other South East States, Yes.
